PUBLIC NOTICE OF INFORMATION SESSIONS AND AUTHORISATION MEETING FOR A
PROPOSED INDIGENOUS LAND USE AGREEMENT (AREA AGREEMENT) UNDER THE NATIVE TITLE ACT 1993 (CTH) FOR PART OF THE AUSTRALIA PACIFIC LNG PROJECT Australia Pacific LNG Pty Limited (APLNG) proposes to develop a world scale, long-term coal seam gas (CSG) to liquefied natural gas (LNG) project in Queensland (APLNG Project). The APLNG Project comprises 3 principal components: the further development of APLNGs Queensland- based CSG fields in South Central Queensland; the construction and operation of a high pressure underground gas transmission pipeline system from the gas fields to a LNG facility on Curtis Island near Gladstone where the CSG will be liquefied (Pipeline Project); and the construction and operation of the LNG facility and of ancillary onshore and marine facilities, including a marine offloading facility and an export terminal containing specialised LNG loading facilities and berths, so that the LNG can be exported to international markets. APLNG proposes to enter into an Indigenous Land Use Agreement (Area Agreement) (ILUA), pursuant to Subdivision C of Division 3 of Part 2 of the Native Title Act 1993 (Cth) (NTA), in relation to that part of the Pipeline Project that is depicted on the map in this notice (ILUA Project). The land and waters affected by the ILUA Project (ILUA Area) are located wholly within an area in respect of which there is currently no registered native title claim. To avoid any doubt, the ILUA Area does not include any part of the area of any of the following registered native title claims: Iman People #2 (QUD 6162/1998); Mandandanji People (QUD 366/2008); and Bigambul People (QUD 101/2009). The ILUA will provide for the consent of the parties to the doing of certain Agreed Acts set out in the ILUA, including the grant of all approvals and land tenure for the ILUA Project, and to the undertaking of the ILUA Project. APLNG will be seeking that the non-extinguishment principle apply to the Agreed Acts and to the undertaking of the ILUA Project. The NTA requires that all reasonable efforts be made to ensure that all persons who hold or may hold native title in relation to land or waters in the ILUA Area are identified. As part of these efforts, APLNG (on a number of occasions, beginning in September 2010) has published notice of its intention to carry out negotiations for the proposed ILUA (these notices have appeared in the National Indigenous Times, the Koori Mail and a number of other newspapers circulating in and around the ILUA Area). APLNG has also consulted Queensland South Native Title Services Ltd (QSNTS), the only representative Aboriginal/Torres Strait Islander body for the ILUA Area. The people who, as a result of these and other efforts, have been identified as the people who hold or may hold native title in relation to land or waters in the ILUA Area are collectively described in the ILUA as the "Area E Native Title Group". The Area E Native Title Group comprises all persons who hold or may hold native title in relation to land or waters in the ILUA Area and includes all persons who identify as Barunggam, Bigambul, Cobble Cobble, descendants of Dolly Clark, descendants of Jack Darlo(w), descendants of Jim Queary, descendants of King Tommy Tommy, descendants of Queen Jessie, Iman, Jarowair, Western Wakka Wakka and Yarowair. Authorisation of the ILUA by the Area E Native Title Group, in accordance with the NTA, will be sought at an Authorisation Meeting to be held on Saturday, 29 June 2013. Prior to that Authorisation Meeting, a number of Information Sessions on the ILUA will be held. The purpose of the Information Sessions is to give APLNG and the Area E Native Title Group negotiation representatives an opportunity to explain the ILUA Project and the ILUA to the members of the Area E Native Title Group generally. Details of the proposed Information Sessions and Authorisation Meeting are set out below.
